Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our pledge
Your health information is personal. Hatch Psychiatry, PLLC ("we") is required by law to:
- Keep your protected health information (PHI) private.
- Give you this notice of our legal duties and privacy practices.
- Follow the notice that is currently in effect.
- Tell you if a breach occurs that may have compromised the privacy or security of your information.
When Utah law gives your information more protection than federal law (HIPAA), we follow the more protective law.
How we use and share your information
We can use and share your information without your written permission for the following purposes.
Treatment. We use your information to provide your care. We may share it with other providers treating you, and with your pharmacy. Example: we send a prescription to your pharmacy, or talk with your primary care provider about a medication.
Payment. We use your information to bill and collect payment from you. We do not bill insurance. If you ask, we will give you a superbill to send to your plan yourself. Example: we process your card payment through our payment processor.
Health care operations. We use your information to run our practice, improve care, and meet legal duties. Example: we use a secure electronic health record and telehealth system (SimplePractice).
Business associates. Some vendors help us run the practice (for example our electronic health record and telehealth company). They must sign agreements to protect your information.
Appointment reminders and service information. We may contact you by email, text, or phone with appointment reminders and information about our services. You can ask us to use a different method.
Other ways we may use or share your information
We are allowed or required to share your information in these situations, only as allowed by law:
- When required by law.
- Abuse or neglect reporting. We must report suspected abuse or neglect of a child or of a vulnerable adult to the proper authorities.
- To prevent a serious threat to health or safety. We may share information with a person who can help prevent or lessen a serious and imminent threat to you, another person, or the public.
- Public health and safety. For example, reporting adverse reactions to medications.
- Health oversight. For example, audits or investigations by licensing boards or government agencies.
- Lawsuits and legal actions. In response to a court or administrative order, or in response to a subpoena when the law allows.
- Law enforcement. For certain law enforcement purposes, as allowed by law.
- Medical examiners and funeral directors. As allowed by law.
- Workers' compensation. As allowed by law, if you file a workers' compensation claim.
- Special government functions. For example, military or national security purposes, as allowed by law.
- Research. We do not currently take part in research. If we did, we would follow the law and get your permission when required.
- Organ and tissue donation. As allowed by law.
Sharing with family and friends
If you agree, or do not object when given the chance, we may share information with a family member, friend, or other person involved in your care. If you are unable to tell us your preference (for example in an emergency), we may share information if we believe it is in your best interest. You can tell us at any time who we may and may not talk to.
Uses that require your written permission
We will not do the following without your written authorization:
- Psychotherapy notes. These are a therapist's separate private notes about counseling sessions. Hatch Psychiatry does not usually keep psychotherapy notes. If we do, most uses and disclosures require your permission.
- Marketing. We will not use your information for marketing without your permission.
- Sale of information. We will never sell your information.
- Any other use not described in this notice.
You may revoke (take back) a written authorization at any time by telling us in writing. This will not undo anything we already did based on your permission.
We do not use your information for fundraising.
Substance use disorder records
Hatch Psychiatry is not a federally assisted substance use disorder treatment program. If we receive substance use disorder treatment records protected by federal law (42 CFR Part 2) from another provider, those records have extra protections. They will not be used or shared in a civil, criminal, administrative, or legislative proceeding against you without your written consent or a court order, as required by federal law.
Your rights
You have the right to:
- See and get a copy of your records. Ask us in writing. You can ask for an electronic or paper copy. We will respond within 30 days. We may charge a reasonable, cost-based fee.
- Ask us to correct your records. If you think your information is wrong or incomplete, ask us in writing. We may say no, but we will tell you why in writing within 60 days.
- Ask for confidential communications. You can ask us to contact you a certain way (for example a certain phone number or email). We will agree to all reasonable requests.
- Ask us to limit what we use or share. We are not required to agree, except in one case: if you pay in full out of pocket for a service, you can ask us not to share information about that service with your health plan, and we will agree unless the law requires us to share it.
- Get a list of disclosures. You can ask for a list of the times we shared your information in the past six years, with some exceptions (such as treatment, payment, operations, and disclosures you authorized). One list per year is free. We may charge a reasonable fee for more.
- Get a paper copy of this notice at any time, even if you agreed to get it electronically.
- Choose someone to act for you. If you have a legal health care power of attorney or legal guardian, that person can use your rights. We will check that the person has this authority.
- Be notified of a breach of your unsecured health information.
- File a complaint if you believe your privacy rights were violated (see below).
Changes to this notice
We may change this notice. Changes will apply to all information we have about you. The current notice will be posted on our website, hatchpsychiatry.com, and available in the SimplePractice Client Portal. You can ask us for a copy at any time.
